Terms of Service

These terms are a binding agreement between you and MailRoundup ("MailRoundup", "we", "us") governing your access to and use of the MailRoundup service. By creating an account or sending mail through our API you agree to these terms. If you do not agree, do not use the service.

1. The Service

MailRoundup provides a transactional email delivery platform, including an HTTP API, client libraries, delivery logs, and a dashboard. We are continuously improving the service and may add, change, or remove features. We will give reasonable notice of material changes that affect how you use the service.

2. Your Account

You are responsible for the accuracy of the information you give us, for keeping your API keys and account credentials confidential, and for all activity that happens under your account. Notify us immediately at security@mailroundup.com if you believe an API key has been exposed or your account has been compromised.

You must be at least eighteen years old and legally able to enter into contracts to use MailRoundup. If you use the service on behalf of a company, you confirm that you have authority to bind that company to these terms.

3. Acceptable Use

MailRoundup exists to deliver the one-to-one mail your users are expecting. You agree not to use the service for any of the following, and doing so is a material breach of these terms:

  • Unsolicited bulk mail, promotional mail, or any form of spam, whether commercial or not.
  • Sending to purchased, rented, scraped, appended, or otherwise non consenting lists. Every recipient must have asked to receive mail from you.
  • Cold outreach, cold sales, or cold recruiting, including warm-up sequences and drip campaigns aimed at people you have no prior relationship with.
  • Sending content that is unlawful, defamatory, obscene, harassing, misleading, or that infringes another person's rights.
  • Phishing, credential harvesting, malware distribution, or impersonation of any person, brand, or organization.
  • Interfering with the service, attempting to bypass rate limits or authentication, or probing for security vulnerabilities without a written engagement.

We monitor aggregate abuse signals from receiving mail providers. If your account trips those signals we may throttle sending, require you to correct the underlying issue, or suspend the account. Repeat or severe violations result in termination without refund. We reserve the right to remove any specific customer whose mail threatens the health of the wider platform.

4. Content And Data

You retain all rights to the content of the messages you send. You grant us the limited right to process that content only as needed to deliver it and to provide the service, as described in our privacy policy. You are responsible for making sure the content you send, and the way you collect recipient consent, complies with all laws that apply to you, including CAN SPAM, CASL, GDPR, and equivalent regimes.

5. Fees And Payment

Paid plans are billed monthly in advance in United States dollars. Fees are non refundable except where required by law. If your usage exceeds the volume included in your plan, overage is billed at the rate shown on your dashboard. We may change prices with at least thirty days notice, which will not affect the term you have already paid for.

6. Service Availability

We work hard to keep MailRoundup fast and available. We publish status updates and incident reports at status.mailroundup.com. We do not, however, promise the service will be uninterrupted or error free. We may perform scheduled maintenance and will provide advance notice whenever we reasonably can.

7. Disclaimers

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that any specific message will be delivered to any specific inbox, since final delivery is decided by the receiving mail provider.

8. Limitation Of Liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to these terms. Each party's total liability for any claim arising out of or related to these terms is limited to the fees you paid to MailRoundup in the twelve months before the event giving rise to the claim.

9. Termination

You may cancel your account at any time from your dashboard. We may suspend or terminate your account for material breach of these terms, including violations of the Acceptable Use section, non payment, or use of the service in a way that endangers our platform or our other customers. On termination your right to use the service ends immediately, and we may delete your data after the retention periods described in our privacy policy.

10. Changes To These Terms

We may update these terms from time to time. If we make material changes we will notify account owners by email at least thirty days before the changes take effect. Continued use of the service after that date means you accept the new terms.

11. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law rules, and any dispute will be resolved in the state or federal courts located in San Francisco County, California.
